Canon I — Foundations

Principle

Trademarks identify proprietary systems. Constitutional language explains universal principles. The Constitution should read like a governing framework, not a trademark registry. Trademark protection is strongest when applied selectively to proprietary intellectual property and omitted from universal concepts.

Definition

The Constitutional Drafting Standard establishes consistent trademark usage across all Transformation Intelligence™ publications. It distinguishes between: proprietary intellectual property (™ retained), constitutional doctrine (no ™ on explanatory language), taxonomies and classifications (no ™ on structural components), scientific and common language (no ™ on universal terminology), and named metrics unique to TI™ (™ retained). The Constitution should communicate with the precision of law, the clarity of science, and the permanence of institutional doctrine.

Operating Law

Editorial Test — three questions before assigning ™: 1. Is this a proprietary product, framework, metric, or methodology unique to Transformation Intelligence™? If yes, retain ™. 2. Is this a universal concept, classification, stage, or explanatory term? If yes, omit ™. 3. Would the term still make sense in an academic textbook or constitutional document without the trademark? If yes, omit ™ unless it identifies proprietary IP.

Implications

  • 1.Rule I — Trademark Proprietary Systems (™ retained): proprietary products, frameworks, methodologies, metrics, and branded architectural components. Examples: Transformation Intelligence™, The Lens™, Lens Analysis™, Transformation Signal Network™, Decision Visibility Infrastructure™, Transformation Capacity™, Transformation Efficiency™.
  • 2.Rule II — Constitutional Doctrine: Constitutional articles, principles, and explanatory language avoid unnecessary ™ unless referencing a formally named proprietary framework. Correct: 'Organizations create value by converting evidence into coordinated action.' Not: 'Organizations create value by converting Evidence™ into Coordinated Action™.' The Constitution explains ideas. It does not trademark every noun.
  • 3.Rule III — Taxonomies and Classifications: Categories, stages, levels, and taxonomies are constitutional classifications, not proprietary names. No ™. Examples: Five Evidence Layers, Verified Evidence, Supported Inference, Observation, Pattern, Validated Pattern, Hypothesis, Speculation.
  • 4.Rule IV — Scientific and Common Language: Widely recognized scientific, legal, financial, and organizational terminology remains unmarked. Examples: Evidence, Intelligence, Trust, Governance, Finance, Leadership, Strategy, Biology, Transformation, Decision, Organization.
  • 5.Rule V — Metrics and Named Indices: Named metrics unique to TI™ retain ™. Examples: Transformation Capacity™, Transformation Efficiency™, Decision Capital™, Intelligence Utilization™.
  • 6.Rule VI — Constitutional Progressions: Sequential models and maturity progressions written without ™. The progression represents the evolution of knowledge, not a collection of proprietary products.
  • 7.Rule VII — Visual Simplicity: ™ used sparingly. Overuse reduces readability and diminishes the visual distinction of genuinely proprietary concepts. The Constitution should appear authoritative, academic, legislative, durable, and timeless — not promotional.
  • 8.Reference Table — Use ™: Company/platform (Transformation Intelligence™, The Lens™), Products (Lens Analysis™, Transformation Blueprint™), Proprietary frameworks, Proprietary metrics, Architectural components. Omit ™: Generic concepts (Evidence, Trust, Knowledge, Governance), Taxonomies, Maturity stages, Constitutional articles, Scientific terminology.
  • 9.Relationship to TI-048/049: TI-054 is the operational drafting standard that extends TI-048 (seven-rule trademark framework) and TI-049 (Terminology Convention) with the Editorial Test, reference table, and visual simplicity principle. Together TI-048, TI-049, and TI-054 constitute the complete constitutional style governance system.
